INSTRUCTIONS on the order of domain name registration in the space of the hierarchical names of the national segment of the Internet network

CHAPTER 1
GENERAL PROVISIONS

  1. The present Instructions are elaborated in accordance with the Decree of the President of the Republic of Belarus No. 60 dated February 01, 2010 “On measures of the improvement of the Internet network national segment use” (National register of the legislative acts of the Republic of Belarus, 2010, N 29, 1/11368) and determine the order of domain names registration in the field of hierarchical names of the national segment of the Internet network, including the requirements to legal entities, planning to fulfill the registration of the domain names, which consider their financial and economic state and feasibility.
  2. For the purposes of the present Instructions, the terms and definitions are used in the meanings established by the Decree of the President of the Republic of Belarus №.60, dated February 1, 2010, as well as the following terms and definitions are used:

    Domain administrator - an individual, an individual entrepreneur, or a legal entity who has signed a contract on the registration of a domain name and performs the domain administration or who was given the domain administration rights under the procedure established by these Instructions;

    Administrator of the national domain zone - Operational and Analytical Centre under the aegis of the President of the Republic of Belarus No. 60 dated February 1, 2010, specially authorized by a state authority in the sphere of security of the national segment of the Internet network use;

    Domain administration - implementation by the domain administrator of the authority to use the domain in accordance with these Instructions, including the transfer of rights to administer the domain, the waiver of these rights, transfer, changing of information for domain delegation;

    Domain delegation - transfer of information (and its subsequent use) to the national domain zone by the register relating to the domain and servers of the domain names (DNS) providing its functioning, their network addresses;

    Domain zone - a field of the hierarchical space of the domain names in the Internet network which is indicated by a unique domain name;

    Domain name (domain) - a symbolic (alphanumerical) designation formed in accordance with the international rules of the Internet network addressing intended for the named call of the informational Internet resource of the domain administrator and corresponding to a certain network address;

    Applicant - an individual, an individual entrepreneur, or a legal entity who has applied for the registration of a domain name;

    Internet resource - website, website page, web portal, mail service, forum, blog, chat, and other resources connected to the Internet network;

    National domain zone - a hierarchical segment of the Internet network consisting of the set of complexes of software and hardware tools providing the functioning of domains of the first (higher) level ".by" and ".бел";

    Suspension of domain administration - temporary restriction of the domain administrator to transfer the rights for domain administration, to waive these rights, to carry out the transfer, to change information for domain delegation;

    Suspension of domain delegation - temporary blocking of the use in the national domain zone of information about the domain and servers of domain names (DNS) providing its functioning, their network addresses, which results in impossibility of a named call to the corresponding Internet resource;

    Registrar - a legal entity of the Republic of Belarus rendering services relating to the domain names registration in the national segment of the Internet network;

    Domain name registration - introduction of information into the national domain zone register, which is necessary for domain functioning;

    National domain zone register - the centralized array of databases of the national domain zone containing information on the registered domain names;

    Network address - network (logical) identifier of electronic means of communication in a data communication network organized on the basis of packet switching principles based on the IP protocol;

    Technical events - a complex of works relating to the provision of domain names servers functioning, timely introduction, updating, storage, and presentation of the information necessary for the provision of domains functioning, and the technical provision of the equipment efficiency of a registrar, a technical administrator of the national domain zone;

    Technical administrator of the national domain zone - a legal entity of the Republic of Belarus providing the functioning of the national domain zone;

    Transfer - change of the domain registrar.

  3. The registration of domain names is performed with the purpose of their further use for a named call to the Internet resource of the domain administrator.
  4. Domain names can be of the first, second, third, and subsequent levels. The domain name level is determined by the ordinal number of a symbol sequence separated by a dot and located to the left of the first (higher) level domain name “.by” or “.бел”.
  5. A domain name in the “.by” domain zone must contain at least two and no more than sixty-three letters of the Latin alphabet, numbers, symbols, “hyphen” (“-”), and must not begin or end with the “hyphen” (“-“) symbol, and also must contain the “hyphen” (“-“) symbol in the 3rd and 4th positions simultaneously.

    A domain name in the “.бел” domain zone is formulated with the use of letters of the Belarusian or Russian alphabet, numbers, symbols, “hyphen” (“-”) and “apostrophe” (“ ' ”), which when translated into the Latin transliteration constitute in total at least two and not more than sixty-three letters, numbers, symbols, and must not begin or end with the “hyphen” (“-”) symbol and (or) the “apostrophe” (“ ' ”).

  6. The following domain names are not subject to the registration, containing words or phrases not corresponding to the common moral and ethic standards, rousing the international hostility, propagandizing violence, cruelty and other actions prohibited by the legislation of the Republic of Belarus.

    While choosing a domain name, including in case of its registration according to the results of auctioning, an applicant should avoid the names that are identical or similar to the degree of confusion with the titles of the registered means of individualization of the participants of civil transactions, goods, works or services, if the applicant is not a holder of the right for a brand name, a trademark or a service mark owner, or a person having the right to use the geographical indication.

  7. Interaction of the national domain zone administrator, technical administrator of the national domain zone, registrars, domain registrars and administrators may be performed by means of electronic messages using e-mail addresses indicated in the cooperation agreement between the national domain zone administrator and the registrar concluded according to the form of Annex 1 (hereinafter – the cooperation agreement), or in the national domain zone register (hereinafter – the register).

  8. Information about registered domain names of the national segment of the Internet network and their administrators is placed in open access into the national information and reference system of domain names in the national domain zone (WHOIS service). Placement into this system of personal data of the domain administrator - an individual, with the exception of an individual acting as an individual entrepreneur, is carried out with his consent.

    Requirements for the national information and reference system of domain names in the national domain zone are defined in Annex 2.

CHAPTER 2
REGISTRAR

  1. The functions of the registrar can be performed by a legal entity of the Republic of Belarus, with which the administrator of the national domain zone has concluded a cooperation agreement and which must ensure the availability of:

    • net assets value of at least 30,000 euros at the rate of National Bank of the Republic of Belarus on the basis of the balance sheet and the calculation of the net assets value (for legal entities that apply the simplified taxation system and keep a record in the income and expenditure book - based on the information of this book) for the first day of the first month of the quarter, in which the cooperation agreement is concluded, as well as during the entire period of the implementing activities for the registration of domain names;
    • complex of software and hardware tools corresponding to the requirements stated in Annex 3 (for the date of concluding the cooperation agreement, as well as during the entire period of the implementing activities for the registration of domain names).
  2. A legal entity, which has expressed a desire to implement activities for the registration of domain names, applies to the technical administrator of the national domain zone for testing the complex of software and hardware tools.

    Based on the test results of the complex of software and hardware tools, the technical administrator of the national domain zone sends certificates on test results to the legal entity that has expressed a desire to implement activities for the registration of domain names and to the administrator of the national domain zone.

  3. The cooperation agreement is concluded after submitting to the administrator of the national domain zone:

    • by the technical administrator of the national domain zone - certificate on test results containing a conclusion on the compliance of the complex of software and hardware tools of the legal entity that has expressed a desire to implement activities for the registration of domain names with the requirements of Annex 3;
    • by the legal entity that has expressed a desire to implement activities for the registration of domain names - the balance sheet and the calculation of the net assets value (by the legal entity that applies the simplified taxation system and keeps a record in the income and expenditure book – extracts from this book) as of the first day of the first month of the quarter, in which the cooperation agreement is concluded that confirms its net assets value.
  4. After concluding the cooperation agreement, the legal entity that has expressed a desire to implement activities for the registration of domain names acquires the status of a registrar and obtains access to the register.
  5. The registrar is obliged:

    • to present the required information on domain name registration to the national domain zone administrator and technical administrator of the national domain zone upon their request within 3 days;
    • to ensure compliance with the requirements on information protection (including personal data) when it is received, collected, processed, accumulated, stored, transferred, and provided, requirements on information usage;
    • within three years from the term expiry of the agreement on registration of the second, third, and subsequent level domain names, if a longer period is not provided by the legislation in the field of archiving and record management, to store agreements on registration of the second level domain names, applications, information on agreements on registration of the third and subsequent level domain names (date of conclusion and agreement number, validity period, information about the person who signed the agreement on behalf of the applicant), other information identifying the applicants, information about domain administrators and about transfer of domain administration rights;
    • in case of liquidation or termination of activities for the registration of domain names, to transfer to the technical administrator of the national domain zone information on agreements on registration of the second, third, and subsequent level domain names (date of conclusion and agreement number, validity period, information about the person who signed the agreement on behalf of the applicant), other information identifying the applicants, information about domain administrators and about transfer of domain administration rights, archive base of these applications;
    • to fulfill other requirements of these Instructions and the cooperation agreement.

CHAPTER 3
DOMAIN NAME REGISTRATION <*>

  1. To register a domain in the national domain zone, the applicant submits an application to the registrar and enters into an agreement with him for the domain name registration (hereinafter - the registration agreement).
  2. Registration agreements with applicants - legal entities of the Republic of Belarus, individual entrepreneurs of the Republic of Belarus, as well as individuals permanently residing in the Republic of Belarus, are concluded and executed directly by the registrar.
  3. The registrar, taking into account the legislation requirements, including these Instructions, has the right to instruct foreign legal entities to enter into agreements that provide registration of domain names in the national domain zone with respect to non-resident applicants <**>. The rights and obligations under such agreements concluded on behalf of the registrar by a foreign legal entity must arise directly with the registrar.

    Information on the foreign legal entity, which is specified in the first part of this paragraph, in the amount provided in the fourth sub-paragraph of paragraph 18 of these Instructions is entered into the register by the registrar upon registration of the corresponding domain name.

    * - In the clauses 3-7 of the Instruction terms “domain name”, “domain” mean second level domain names (domains).
    ** - For the purposes of this Instruction, a non-resident mean foreign legal entities, foreign individual entrepreneurs, as well as citizens or subjects of a foreign state, stateless persons who do not have a permit for the right to permanent residence in the Republic of Belarus.

  4. The registrar’s obligation on registering a domain name under the registration agreement arises from the moment when the registrar receives a properly completed application of the applicant and the payment for domain name registration.

    On the day of occurrence of the obligation to register a domain name, the registrar registers the domain name by entering information on the domain and its administrator in the register.

  5. In the application for domain name registration, the applicant must indicate the following reliable information to be entered by the registrar into the register:

    • individual - surname, first name, patronymic (if any), address of residence, identity document data (type of document, series (if any) and number, identification number (if any), date of issue, name of the issuing authority), e-mail address, contact telephone number;
    • individual entrepreneur - information specified in the second sub-paragraph of this paragraph, as well as information on state registration (registration or other identification number, name of the body (organization) that carried out state registration, registration date, decision number (if any));
    • legal entity - full name, location, information on state registration (registration or other identification number, name of the body (organization) that carried out state registration, date of registration, decision number (if any)), payer’s account number (if any), e-mail address, contact telephone number.
  6. Domain administration rights arise from the moment of entering into the registry of information about the domain and its administrator, and are effective during the term of the domain name registration.

    The domain name registration is valid for one or two years as may be chosen by the applicant.

    The expiration of the validity period of the registration agreement is determined by the expiration of the validity period of the domain name registration.

  7. The domain administrator is obliged:

    • to use the domain name for a named call to the Internet resource of the domain administrator;
    • to inform the registrar about all changes to the information on the domain administrator entered into the register not later than within seven days from the date of such changes;
    • within a 3 days’ term upon request of the registrar and (or) the national domain zone administrator, to present documents confirming credibility of information about the domain administrator entered into the register (including the identification document – for individuals and individual entrepreneurs, state registration documents (if necessary, extract from the trade register of the country of incorporation or another equivalent proof of legal status in accordance with the legislation of the country of incorporation (registration)) - for legal entities and individual entrepreneurs);
    • not later than the day following the day of receipt from the administrator of the corresponding domain of the third and subsequent levels of information subject to entry into the register, to transfer such information to the registrar;
    • to perform other obligations stipulated by these Instructions and the registration agreement.
  8. When resolving disputes related to the sequence of occurrence (acquisition) of the rights for registering (administering) a domain name, all other things being equal, the priority is determined by the date and time when the applicant made all the actions necessary for the occurrence of the registrar’s obligation to register a domain name.
  9. The registrar has no right to register domain names with respect to himself.
  10. Domain administration can be suspended:

    • by the administrator of the national domain zone and (or) the registrar in cases provided for in these Instructions;
    • by the court when considering cases relating to the registration and (or) use of a domain name.

CHAPTER 4
DOMAIN DELEGATION, TRANSFER

  1. Domain delegation is carried out to provide the possibility of a named call to the Internet resource of the domain administrator.
  2. Delegation of a domain name in terms of the information transfer to the national domain zone is carried out by the registrar entering the necessary information into the register on the basis of the application of the domain administrator.
  3. The domain administrator within the validity period of the domain name registration has the right to send to the registrar applications specifying information for domain delegation, for suspending or resuming domain delegation, with the exception of periods when domain administration and (or) delegation is suspended by the administrator of the national domain zone, the registrar, or the court.
  4. Domain delegation can be suspended:

    • by the administrator of the national domain zone and (or) the registrar in cases provided in these Instructions;
    • by the court when considering cases relating to the registration and (or) use of a domain name.

    During the period of suspension of domain delegation, the registrar provides addressing of the corresponding named calls to his own Internet resource containing information about such suspension.

  5. Domain delegation is terminated by the registrar:
    • in case of exclusion of the domain from the register;
    • on the basis of the court decision.
  6. The transfer is performed on the basis of applications of the domain administrator sent to the registrar with whom the registration agreement was concluded, and to the registrar with whom a new registration agreement is expected to be concluded.

    In case of transfer, the domain administrator concludes a registration agreement with the new registrar with a validity period until the expiry of the domain name registration stipulated by the registration agreement with the former registrar.

    The transfer operation (including the conclusion of the registration agreement with the new registrar) is carried out within seven days from the receipt of the domain administrator’s application by the current registrar.

  7. In case of making a decision to liquidate or terminate activities for the registration of domain names, the registrar within 15 days must notify domain administrators about the need of transfer.

    Domain administrators have the right to perform a transfer operation within 15 days from the receipt of such a notification.

    After the expiration of the time period specified in the second part of this paragraph, provision of domain name functioning, for which no transfer has been made, is transferred by the registrar to the technical administrator of the national domain zone.

    If during the validity period of domain name registration, whose provision of functioning is transferred to the technical administrator of the national domain zone, its administrator does not enter into a registration agreement with a new registrar, this domain after the expiry of the specified period is excluded from the register by the technical administrator of the national domain zone.

CHAPTER 5
EXTENSION OF THE DOMAIN NAME REGISTRATION DURATION

  1. The validity period of domain name registration can be extended an unlimited number of times by extending the registration agreement each time for one or two years as may be chosen by the domain administrator.
  2. Not later than one month prior to the expiration of the validity period of the registration agreement, the registrar sends a reminder to the domain administrator about the expiration of the validity period of the registration agreement and about the possibility of its extension.
  3. The domain administrator has the right to send an application for the registration agreement extension and to pay for the extension of the validity period of domain name registration not earlier than six months prior to the expiration of the validity period of the current registration.
  4. The registration agreement is considered extended after the registrar receives from the domain administrator an application for extension and the payment for extension of the validity period of the domain name registration.
  5. If at the time of the expiration of the validity period of the registration agreement the applicant has not made any actions to extend it, the registrar suspends administration and delegation of this domain.

    The domain remains in this state until the registrar receives from the domain administrator an application for extension and the payment for the extension of the registration validity period, but for no more than 30 days. At the same time, the registrar’s obligations under the registration agreement are in effect considering the suspension of domain administration and delegation.

    If the registration agreement is extended during the period specified in the second part of this paragraph, the validity period of domain name registration and the agreement validity period are considered extended from the day following the expiry date of the previous validity period of domain name registration. After extending the validity period of the registration agreement, domain administration and delegation are resumed.

    If the domain administrator has not extended the validity period of the registration agreement within the time specified in the second part of this paragraph, the domain name is excluded from the register by the registrar.

  6. Information about the extension of the validity period of domain name registration is entered into the register by the registrar.
  7. If the validity period of domain name registration expires during the period when domain administration was suspended, the registration validity period is extended until the end of this suspension period.

CHAPTER 6
TRANSFER OF THE RIGHTS FOR DOMAIN ADMINISTRATION, RENUNCIATION OF THE RIGHTS FOR DOMAIN ADMINISTRATION

  1. The rights for domain administration, unless otherwise stipulated by legislative acts, can be transferred by the domain administrator to another person under the agreement on assignment (cession) of such rights on the basis of a court decision, and also may be transferred by inheritance or by succession in case of reorganization of a legal entity.
  2. The transfer of the rights for domain administration under the agreement is allowed only within the validity period of domain name registration.

    In order to enter information on the transfer of the rights for domain administration under the agreement into the registry, the domain administrator submits to the registrar an application for the transfer of the rights for domain administration, as well as information about the agreement on assignment (cession) of domain administration rights (date of conclusion and agreement number, information on signatories and on documents confirming their authority), and the person to whom these rights are transferred submits an application containing consent to the acceptance of such rights under the agreement on assignment (cession) of domain administration rights, as well as personal information in the amount provided in paragraph 18 of these Instructions.

    The registrar has the right to demand from the parties of the agreement on assignment (cession) of domain administration rights a copy of this agreement for entering information into the register about the change of the domain administrator.

    From the moment the registrar enters information about the new domain administrator into the register, the new domain administrator acquires the rights for its administration, and in this case the reciprocal rights and obligations of the parties under the registration agreement are in effect considering the change of the domain administrator.

  3. Information about the change of the domain administrator can be entered into the register on the basis of a court decision.

    The registrar has the right to request from the domain administrator, to which the rights for domain name administration have been transferred based on a court decision, the full amount of information about him provided in paragraph 18 of these Instructions.

    The rights for domain administration arise with the new domain administrator from the moment the registrar enters such information into the register, unless otherwise established by a court decision.

  4. The transfer of the rights for domain administration by inheritance is possible in case of entering into inheritance and submitting to the registrar the proof of entering into inheritance within the validity period of domain name registration, as well as within the 30-day period defined by the second part of paragraph 35 of these Instructions. In this case, in the event of death of the domain administrator, the domain registration term may be extended in the manner similar to that established in paragraphs 31 to 35 of these Instructions at the request of an interested person in the context of adopting, in accordance with the legislation, of measures for protecting the rights for domain administration and managing them as part of the inheritance.

    In order to enter information into the register about the transfer of the rights for domain administration by inheritance, the heir shall submit to the registrar an application containing information about himself in the amount provided in paragraph 18 of these Instructions, as well as documents confirming entry into the inheritance.

    If the registrar discovers information about the death of the domain administrator, the registrar, within a reasonable time, sends a notification by mail and e-mail, according to the contact information of the domain administrator indicated in the register, with a proposal to take measures for protecting the rights for domain administration and managing them as part of the inheritance. If such measures are not taken within 30 days from the date of the last notification, the registrar suspends the delegation of the corresponding domain name. The registrar resumes delegation of this domain in the following cases:

    • entering into inheritance and performing by the heir of actions necessary to transfer the rights for domain administration in the order established by the first and second parts of this paragraph;
    • adoption in accordance with the legislation of measures for protecting the rights for domain administration and managing them as part of the inheritance.

    In case of failure to submit to the registrar during the validity period of domain name registration, as well during the 30-day period specified in the second part of paragraph 35 of these Instructions, of documents required for entering information about the transfer of the rights for domain administration by inheritance to the register, the domain name is excluded from the register by the registrar.

  5. In order to enter information about the transfer of the rights for domain administration in the order of succession in case of reorganization of a legal entity, the successor submits to the registrar an application specifying information about himself in the amount provided in the fourth sub-paragraph of paragraph 18 of these Instructions, as well as documents confirming the fact of succession (documents on state registration, certificate of transfer or division balance sheet). The rights for domain administration arise with the new domain administrator from the moment the registrar enters such information into the registry.
  6. The registrar enters information about the new domain administrator into the register not later than the day following the day of receipt of the application (if necessary) and documents confirming the transfer (change, transition) of the rights for domain administration in accordance with these Instructions.
  7. The domain administrator is entitled to waive the rights for domain administration at any time during the registration validity period, except for the period of suspension of domain administration.
  8. In order to waive the rights for domain administration, the domain administrator submits the corresponding application to the registrar.

    The waiver of the rights for domain administration is a unilateral refusal by the domain administrator to perform the registration agreement, and entails the exclusion of the domain name from the registry by the registrar.

CHAPTER 7
EXCLUDING DOMAINS FROM THE REGISTER UPON DETECTING VIOLATIONS RELATED TO THEIR REGISTRATION AND USE

  1. If there is information about violations related to the registration and (or) use of the domain (hereinafter unless otherwise stated - violations), the administrator of the national domain zone sends a notification to the registrar.

    In accordance with the competence defined by the legislation, the registrar can also be notified about violations by courts and state bodies.

    Other legal entities, individual entrepreneurs, individuals can apply to the registrar with such a notification if they have a final and binding court decision confirming the violations. In this case, the notification must contain the surname, first name, patronymic (if any), address of the place of residence of the individual or individual entrepreneur, or the full name and location of the legal entity, indication of the domain name, statement of the nature of the violation, personal signature of the individual or the signature of the individual entrepreneur with a seal affixed, if the individual entrepreneur has a seal, or the signature of the chief (authorized person) of the legal entity certified by the seal of the legal entity.

    The notification of violations by the domain administrator of rights for registered means of individualization of participants of civilian circulation, goods, works, or services is submitted only if the right holder has a court decision confirming such a violation.

    If violations originate from the registrar, he is obliged to eliminate them within a period not exceeding seven days from the date of receipt of the notification.

    If violations originate from the domain administrator, the registrar on the basis of the notification, not later than the day following the day of its receipt, informs the domain administrator who is obliged to eliminate the committed violations within a period not exceeding seven days from date of his receipt of information about violations.

    Information about violations, including information contained in the notification, is entered into the register by the registrar.

  2. In case of independent identification of violations in terms of domain name registration, which originate from the domain administrator, the registrar informs the domain administrator about the need to eliminate them within a period not exceeding seven days from the moment the domain administrator receives information about violations.

    If the violations identified by the registrar are not eliminated by the domain administrator in a timely manner, the registrar sends information on such violations to the administrator of the national domain zone with supporting documents attached.

  3. For the period of elimination of violations, the administrator of the national domain zone has the right to suspend domain delegation and (or) administration.
  4. The administrator of the national domain zone has the right to exclude the domain name from the register in case of:

    • failure of the registrar and (or) domain administrator to eliminate violations within the specified time period;
    • identifying the fact of a repeated violation relating to the same domain name by the domain administrator (for 12 consecutive months after informing by the registrar about the elimination of the previous violation).

    If a domain is excluded from the registry, the registration agreement is terminated.

  5. Unless otherwise established by the third part of this paragraph, the registration agreement for a domain name excluded from the register is concluded by holding an auction. This auction is held by the technical administrator of the national domain zone in accordance with the procedure agreed with the administrator of the national domain zone. The money received from the auction, minus the cost of domain name registration, is used to support institutions for orphans, children left without parental care, children with disabilities, and special needs children.

    If the domain name was put up for auction, but no bids were made on it, the technical administrator of the national domain zone removes the domain from the auction, after which this domain name becomes available for registration on a general basis.

    The technical administrator of the national domain zone has the right to not put up domains for auction that are identical or similar to the degree of confusion with the names of registered means of individualization of participants in civil transactions, goods, works, or services. The indicated domain names can be registered at the request of the right holder who has presented proof of his rights for the appropriate means of individualization.

CHAPTER 8
PECULIARITIES OF REGISTRATION OF THE THIRD AND SUBSEQUENT LEVEL DOMAINS

  1. In order to register the third and subsequent level domains (hereinafter – lower level domain) in the national domain zone, the applicant concludes an agreement for ensuring the functioning of the domain name with the administrator of the second or higher level domain (hereinafter - the agreement).

  2. Registration of lower level domains in the national domain zone is performed provided that the administrator of the corresponding second level domain provides reliable information to the registrar:

    • about the domain;
    • about the administrator of the lower level domain in the amount specified in paragraph 18 of these Instructions;
    • about the agreement (date of conclusion and agreement number, validity period, information about the person who signed the contract on behalf of the applicant).
  3. The functioning of the lower level domain is allowed, and the rights for its administration arise from the moment the registrar enters the information about the domain and its administrator into the register.

  4. The agreement term must not exceed the term of the agreement for registration of the corresponding higher level domain.
  5. The administrator of the lower level domain is obliged:

    • to use the domain name for addressing the Internet resource of the domain administrator;
    • to inform the administrator of the corresponding second level domain about all changes in the information about the domain administrator entered into the register within a period not later than seven days from the date of such changes;
    • within a 3 days’ term upon request of the national domain zone administrator and (or) the registrar, to present documents confirming credibility of information about the domain administrator entered into the register (including the identification document – for individuals and individual entrepreneurs, state registration certificate (extract from the trade register of the country of incorporation or another equivalent proof of legal status in accordance with the legislation of the country of incorporation (registration)) - for legal entities and individual entrepreneurs);
    • to perform other obligations stipulated by these Instructions and the agreement.
  6. In case of identifying violations related to the registration and use of the lower level domain, the registrar is notified and the administrator of this domain is informed about the need to eliminate the violations in the manner similar to that established in paragraphs 46 and 47 of these Instructions. At the same time, the administrator of the corresponding second level domain is additionally notified.

    If the registrar and (or) the administrator of the lower level domain do not comply with the requirements for eliminating violations, the administrator of the national domain zone is entitled to exclude the domain name from the registry, and the administrator of the corresponding second level domain on the basis of the exclusion decision must stop the technical events required for the functioning of the lower level domain.

    In case of excluding the lower level domain from the registry, the agreement is terminated.

  7. Exclusion of the domain name from the registry entails exclusion of the corresponding lower level domains from the registry.

CHAPTER 9
DOMAIN NAME REGISTRATION BY STATE BODIES

  1. Registration of domain names for state bodies in the domain zones “.бел”, “.gov.by”, and “.mil.by” is performed by the administrator of the national domain zone free of charge.

  2. State authorities using in their activities information, which constitutes state secrets, before the appeal to the administrator of the national domain zone for domain name registration in the domain zones “.бел”, “.gov.by” and “.mil.by”, conclude agreements for the provision of Internet services with the authorized Internet services providers specified by the order of the Operational and Analytical Center under the President of the Republic of Belarus No. 92 dated December 17, 2010 "On approving the list of the Internet services providers authorized to provide Internet services to state bodies and organizations using the information constituting state secrets in their activities" (National Register of Legal Acts of the Republic of Belarus, 2010, N 312, 7/1382).

  3. For domain name registration in the domain zones “.бел”, “.gov.by” and “.mil.by”, state bodies fills in the application form with the help of the national automated information system (hereinafter – NAIS) according to Annex 4.

    Domain name registration is carried out electronically through the NAIS during the day following the day when the application form is filled in by the state body.

    To make changes to the register, the state body through the NAIS corrects the relevant information electronically in the application form.

    The notification on the registration fact or making changes to the register is sent electronically to the e-mail address specified by the state body.

  4. Domain name registration or making changes to the register may be denied, if the state body fails to comply with the requirements of paragraphs 59 and 60 of these Instructions, and if the requested domain name is already registered.
  5. If there is information about violations related to the registration and use of the domain whose administrator is a state body, the administrator of the national domain zone sends a relevant notification to this administrator. The state body is obliged to eliminate the committed violations within a period not exceeding seven days from the date of receipt of information about violations.

    During the period of elimination of violations, the administrator of the national domain zone has the right to suspend domain delegation and (or) administration.

    The administrator of the national domain zone is entitled to exclude the domain name whose administrator is a state body from the registry in case of:

    • failure to eliminate violations within the specified time period;
    • identifying the fact of a repeated violation relating to the same domain name (for 12 consecutive months after informing about the elimination of the previous violation).

CHAPTER 10
TECHNICAL ADMINISTRATOR OF THE NATIONAL DOMAIN ZONE

  1. The technical administrator of the national domain zone may be a registrar determined by the administrator of the national domain zone based on the results of the competition conducted in the manner determined by the administrator of the national domain zone.

    The competition is held once every 10 years after the International Internet Corporation for Assigned Names and Numbers (ICANN) makes a decision on transferring the rights for technical administration of the national domain zone (changing the Technical Contact).

    The competition can be conducted in advance by the decision of the administrator of the national domain zone in case of:

    • identification by the administrator of the national domain zone of violations of the requirements of these Instructions by the technical administrator of the national domain zone;
    • liquidation of the technical administration of the national domain.

    In order for the new registrar to perform the functions of the technical administrator of the national domain zone, the current technical administrator of the national domain zone shall forward to the new technical administrator of the national domain zone information from the register and documents specified by the International Internet Corporation for Assigned Names and Numbers (ICANN) within a period not exceeding one month from the date of announcement of the competition results.

  2. The technical administrator of the national domain zone:

    64.1. ensures functioning of:

    • the national domain zone;
    • the national information and reference system of domain names in the national domain zone in accordance with the requirements of Annex 2;

    64.2. performs:

    • cooperation with international organizations on issues of technical support of the functioning of the national domain zone;
    • technical support of the register, also determines its structure and format taking into account the requirements of these Instructions;
    • registration of the second level domain names on the basis of a request from the administrator of the national domain zone without concluding an agreement;
    • with the consent of the administrator of the national domain zone, provides state bodies with remote access to the registry;

    64.3. for a fee, provides registrars with maintenance services for domain names in the national domain zone. At the same time, the cost of annual maintenance of a domain name in the national domain zone can be changed taking into account the change of the consumer price index for the previous year in relation to the preceding year, changes of economically justified costs for technical support of the register that could not be foreseen at the time of the initial cost calculation, or in connection with changes to the legislation;

    64.4. conducts tests of the complexes of software and hardware tools for compliance with the requirements according to Annex 3;

    64.5. performs other obligations in accordance with the legislation, including these Instructions, as well as obligations stipulated by the cooperation agreement with the administrator of the national domain zone.

on the cooperation of the Operational and Analytical Centre under the President

The Operational and Analytical Centre under the President of the Republic of Belarus, hereinafter referred to as "the administrator of the national domain zone", represented by ________________________________, acting on the basis of _______________________________________, on the one hand, and                  hereinafter referred to as “the registrar”, represented by                  acting on the basis of              on the other hand, collectively referred to as “the parties”, have concluded this agreement as follows:

  1. The Parties are obliged to cooperate under the terms and conditions provided for in this agreement when the registrar performs activities for domain name registration in the national domain zone.
  2. The Registrar is obliged to:

    • carry out activities for domain name registration in accordance with the legislation of the Republic of Belarus, including the Instructions on the order of domain names registration in the space of the hierarchical names of the national segment of the Internet network approved by the Order of the Operative and Analytical Center under the President of the Republic of Belarus N 47 dated June 18, 2010 (hereinafter - Instructions);
    • provide informational interaction of his own domain name registration system with the central database hosted with the technical administrator of the national domain zone in accordance with the established data transfer protocols;
    • notify the administrator of the national domain zone and the technical administrator of the national domain zone about any changes in contact details of the registrar’s specialists authorized to hold activities on the registration of the second level domain names;
    • present to the administrator of the national domain zone information related to domain name registration no later than within three days from receiving the request;
    • in accordance with the legislation, verify the information about the applicant (domain name administrator);
    • take measures for prevention, detection, and suppression of fraud with domain names;
    • keep and provide instant access for the administrator of the national domain zone and the technical administrator of the national domain zone to the archive databases of applications for domain name registration and the audit data for the entire period of performing activities for domain names registration;
    • conduct an annual audit of information security of the domain name registration system, on the basis of which to plan and implement measures for ensuring information protection;
    • provide access to computer facilities and the data of the domain name registration unit to representatives of the administrator of the national domain zone in order to determine the compliance of the registration system with the requirements specified in Annex 3 to the Instructions;
    • perform other obligations stipulated by the legislation regulating the issues of domain name registration in the space of hierarchical names of the national segment of the Internet network.
  3. This Agreement is concluded for an indefinite period.
  4. This Agreement may be terminated:

    • by mutual consent of the parties completed in the form of an additional written agreement;
    • by unilateral refusal of the administrator of the national domain zone from executing the agreement in case of violation by the registrar of the terms of this agreement, as well as the requirements of the legislation regulating the issues of domain name registration in the space of hierarchical names of the national segment of the Internet network;
    • by unilateral refusal of the registrar from executing the agreement provided that the administrator of the national domain zone is notified about the decision to terminate this agreement at least one month prior to the proposed termination date, and that the registrar complies with the procedure for termination of his functions for registering domain names.
  5. The parties are obliged to settle any dispute or disagreement relating to this Agreement by means of negotiations.
  6. If the parties fail to settle all disputes in accordance with paragraph 5 of this Agreement, all disputes arising from this Agreement, including those related to its conclusion, amendment, termination, performance, invalidity, shall be settled by legal means in accordance with the legislation of the Republic of Belarus.
  7. All issues not settled by this Agreement shall be resolved in accordance with the legislation of the Republic of Belarus.
  8. This agreement is made in two copies (one copy for each party) having equal legal force.

REQUIREMENTS
FOR THE COMPLEX OF SOFTWARE AND HARDWARE TOOLS

The complex of software and hardware tools (hereinafter – the complex) must ensure:

  • interaction of the registrar with the register through the xRRP interaction protocol (XML Registry-Registrant Protocol);
  • use of secure network protocols for remote management of the complex;
  • verification of credentials of the complex administrators based on the authentication data; logging and auditing security events;
  • logging and auditing security events;
  • synchronization of the system time set on the complex with the reference time sources of the Republic of Belarus;
  • performing daily backup of information ensuring the integrity and complete recovery of data in the event of software and (or) hardware failures;
  • protection against unauthorized access..

The computer network, which includes the complex, must contain firewalling and filtering facilities.

The complex must be provided with uninterrupted power supply.
