 Rules of registration and delegation of domain names in BY domain

1. GENERAL PROVISIONS.

1.1. These rules constitute and establish the procedure of registration and delegation of domain names (domains) in the national segment of Internet (BY zone). BY - is the official two-letter code of Republic of Belarus according to the International Standard ISO3166-1, adopted by the United Nations Organization. Registration (delegation) of domains is performed according to recommendations of International organizations for assignment of names and numbers in Internet – ICANN, IANA.

1.2. Registration and delegation of second level domain names in BY zone are coordinated by the State Center for Security of Information under the President of Republic of Belarus (hereinafter the SCSI). The SCSI acts under the "Statute on State Center for Security of Information under President of the Republic of Belarus", approved by the Decree of the President of Republic of Belarus dated November, 28 2000 No 639.

1.3. The SCSI is the Administrator of top level domain BY and cooperates with International organizations establishing policies of registration and assignment of domain names (ICANN, IANA, ccTLD etc.).

1.4. The SCSI develops and introduces normative legal documents in registration, delegation and administration of domain names in BY zone.

1.5. As provided in the decision and confirmation entry to the ccTLD database of Top International Organizations on Assignment of Internet Names and Numbers - ICANN and IANA, technical administration and support of the Register of BY domain are carried out by "Open Contact" acting on these Rules and Statute of the Company (hereinafter called the "Technical Administrator").

1.6. The SCSI determines legal entities authorized to perform technical procedures in registration of second level domain names in BY zone (hereinafter called "Registrars") in compliance with these Rules and Requirements to Registrars, provided in the Appendix 1. Cooperation of the Administrator of BY zone and Registrars is done based on bilateral agreements.

1.7. Technical activities in registration and delegation of domains in BY zone should be done with reference to contracts and in accordance with the requirements of a Registrar.

1.8. Administration of the top level domain BY, registration and delegation of second level domains in BY zone, and other subsequent levels should be carried out in compliance with these Rules and requirements of international standards and recommendations (Appendix 3).
When using this document one should be guided by the list of terms and definitions (Appendix 2).

2. REGISTRATION PROCEDURE FOR SECOND LEVEL DOMAINS IN BY DOMAIN.

The SCSI performs registration of second level domain names in BY zone and delegates rights to administer them in compliance with the provisions on administration of domain names in BY zone listed below.

2.1. Registration and delegation of second level domain names in BY zone is allowed to private persons and legal entities residing in Republic of Belarus, as well as to private persons and legal entities from other countries.

2.2. It is recommended that public, governmental, military and law-enforcement institutions of Republic of Belarus should register third level domain names under GOV.BY, MIL.BY respectively.

2.3. When choosing a domain name, it is recommended that applicants use name of their company or group of institutions in whose name they are applying. It is also recommended that applicants should avoid applying for names coinciding with well-known trademarks or names of other companies.

2.4. An Applicant (Registrant) bears full responsibility for possible violation of rights to any registered trademark or other intellectual property, as well as for any conflicts arising from use of names of other companies.

2.5. Domain name should consist of at least 2 (two), but not more than 63 (sixty three) Latin characters, numbers and hyphens ("-"). It should not start or end with a hyphen symbol ("-").

2.6. Any application for registration of a domain name can be unconditionally rejected or shelved in the following cases:

2.6.1. if a domain name already exists and has been registered to other registrant;

2.6.2. if a domain name contains obscenities and/or word forms contravening to the legislation of Republic of Belarus;

2.6.3. if a domain name does not comply with the requirements of the it. 2.5 of the Rules.

Note: Absence of any information resources in open access in the Internet (in the form of web-site, email server or other presentation of information), or DNS-records does not infer availability of such domain for registration.

2.7. Registrants should use domain names in BY zone pursuant to the current legislation of Republic of Belarus and these Rules.

2.8. The Administrator reserves the right to cancel delegation or registration of any domain, should Registrants or Registrars of second level domains in BY zone violate any provision of the Rules.

2.9. In force majeure situations, namely natural disasters (floods, fires, earthquakes, etc.); war or hostilities both the Administrator and the Technical Administrator should not be liable for any malfunction of BY zone.

2.10. Registration and delegation of second level domains in BY zone is done automatically based on electronic applications (electronic registration).

2.11. Electronic registration of domain names requires the following actions:

2.11.1. check for availability of a domain name to be applied for registration via search service on server of a Registrar interacting with the Register of the BY domain.

2.11.2. selection and completion of the approved form on server of a Registrar and sending completed form to the Register of the BY domain.

2.11.3. consideration of an application by the Administrator of BY within 5 business days starting the day of receipt of such application to the Register of the BY domain.

Decision on each application is sent to the respective Registrar.

2.12. The Technical Administrator can set up additional requirements to the procedure of registration and delegation of domain names unless such requirements contravene to the present Rules.

3. REDELEGATION AND TRANSFER OF SECOND LEVEL DOMAINS IN BY DOMAIN.

3.1. Redelegation of a domain should mean transfer of rights and authority for use of a domain from one Registrant to the other.

3.2. Redelegation of second level domain in BY zone should be performed only after receipt of official application of the current Registrant, and confirmation from the new Registrant that he is ready to obtain rights and authority to use such domain name.

3.3. Modification of records for the redelegated domain name is made to the Register of BY domain after all operations described above in the it. 3.2 have been performed.

3.4. Transfer of domains should mean transfer of rights and authority for technical support of a domain name from one Registrar to another Registrar without interruption of operation of information resources using such domain name.

3.5. Transfer of second level domains in BY zone should be performed pursuant to the Schedule of interaction of Registrars, set by the Technical Administrator.

4. ADMINISTRATION OF DOMAINS IN BY ZONE.

4.1. Administration of any registered domain is done by the Technical Administrator, Registrars and Registrants in accordance with these Rules, Recommendations of International organizations for assignment of names and numbers in Internet - ICANN, IANA (Appendix 3) and Supplementary Rules of administration of third and subsequent levels, established by administrator of the appropriate domain if necessary.

4.2. A Registrar should possess the required level of competence in domain name systems and procedures for their maintenance, as described in the international recommendations RFC-1032, 1033, 1034 and 1591; RIPE-007, 105, 114 (the list of International guidelines is provided in the Appendix 3).

4.3. Registrants of second level domain names in BY zone should inform their Registrar in due course of any changes in operation of their subscribers (change of company name), IP-addresses, DNS-servers, change of responsible officers, disconnection from Internet, etc. The Registrar in his turn should make appropriate modifications in the Register of BY domain.



APPENDICES

Appendix 1

Requirements to a Registrar of domain names in BY zone.

1. Only legal entities of Republic of Belarus can be a Registrar of domain names.

2. Registrar should receive a special permit (license) of the State Center for Security of Information of Republic of Belarus for activities in technical protection of information.

3. Registrar should provide access to computing facilities and the data of domain name registration units for the Administrator of BY domain for periodic checks of conformity of his system with the Rules and technical requirements.

4. Registrar should possess personal Internet node with the following minimum required informational services and subsystems:

  • subsystem of electronic mail;
  • subsystem of Web-server;
  • subsystem of interaction with the Register of BY domain.
5. Registrar interacts with the Register of BY domain for registration and support of domain names via special protocol, defined by the Technical Administrator.

6. Operation of a registration system, as well as solution of any issues in provision of safety of information for its subsystems should be performed by technical support service of the appropriate Registrar.

7. Registrar should arrange reliable operation and round-the-clock control of capacity for work of the system of servers of applied services.

8. Any computing and communication equipment and devices used for operation of the domain registration system should be provided with uninterrupted electric power supply.

9. Automatic system of registration of domain names of a Registrar should:

9.1. contain contact details of a Registrant;

9.2. contain data for the Whois-service;

9.3. contain data of term of delegation of a domain to Registrant;

9.4. contain information about domain names and IP-addresses of DNS-servers for the registered domains;

9.5. contain archive records of processing for every application. Archives should be kept for the whole term of operation of a Registrar;

9.6. provide authorized access to database of registrants for the Administrator of BY domain and Technical Administrator of BY domain;

9.7. allow modification of data for a domain (list of DNS-servers, administrative and contact information of a Registrant) by requests from a Registrant;

9.8. contain not less than one set of parallel equipment; backup system should be put in operation within 10 minutes after failure of the main one.

9.9. guarantee security of information against unauthorized access, its integrity and availability for authorized users.

10. Registrar should arrange technical measures to protect data of a Registrant in order to assure the integrity and availability of registered (delegated) domain name, as well as confidentiality of private information.

11. The following actions should be provided by all servers of information services and subsystems, supported by Registrar:

11.1. provision of remote control over a server should include secure network protocols;

11.2. provision of verification of administrator rights by authentication data;

11.3. provision of audit and journaling of all security events. System time on Registrar's equipment should be synchronized with the reference time sources;

11.4. provision of daily data backup, ensuring integrity and recovery of the data in full in case of software or hardware malfunction;

11.5. provision of protection against unauthorized access to the equipment of domain name registration unit, (located in separate site, closed cabinet, etc.);

11.6. computer aids of domain name registration unit should operate in separate segment of computer network;

11.7. domain name registration unit should include devices of inter-network shielding and filtration.



Appendix 2

Terms and definitions.

Administration of domain - a range of measures for organizational and technical maintenance of operation of a domain name, definition of order of its use.

Delegation of domain - making records about a domain in BY zone and transfer of right of administration to a company (legal entity), whose contact information is listed in the section of Administrative Contact.

Domain name (domain) - section of hierarchical name system in Internet, serviced by a set of domain name servers (DNS) and being under centralized administration. A domain is defined by a domain name.

Redelegation of domain - a set of organizational and technical activities in transfer of rights and authority to use a domain name to another Registrant.

Registrar - a legal entity, providing services to users (registrants) required for registration and delegation of a domain to them, and also performing technical activities for such procedures.

Registrant (applicant) - a person, using and controlling a domain name. Domain administrator is also the registrant of the correspondent name.

Register of BY domain - information system that contain data of registered domains, information about registrants (including WHOIS data) and subsystem of interaction with Registrars.

Registration of domain - organizational and technical activities required to provide operation of a domain within the international system of Internet.

Technical measures - a complex of works carried out to provide operation of domain name servers, timely input, modification and delivery of information, required for normal operation of domains, and also technical maintenance for operability of the main and auxiliary equipment of Registrar's unit.

Level of domain - number of components in domain name, separated by dots ".".
